Exxon seeks dismissal of state suit over Solano County landfill
“Plaintiffs’ scattershot naming of multiple defendant entities fails to provide any facts, as distinct from legal conclusions and formulaic recitations of the claims’ elements, as to why or how Exxon is potentially liable for the hazardous substances purportedly present at the Panoche landfill,” wrote Joseph Duffy of Morgan Lewis & Bockius.




Attorneys for Exxon Mobil Corp. have moved to dismiss California's claim to damages over a toxic landfill in Solano County.
The state's complaint doesn't show ExxonMobil was liable, and also ignored an exclusion in federal law, the oil company argued. Attorney General Rob Bonta filed two cases against oil companies in September citing the federal superfund law.
