9th Circuit asks state justices if medical sceeners can be sued

A woman wants to sue an outside company hired to screen her health for a job application.

A federal appellate panel asked the state Supreme Court to decide whether companies hired by prospective employers to screen job applicants for medical conditions can be held liable if they ask inappropriate questions.

A 9th U.S. Circuit Court of Appeals panel posed the question for the state Supreme Court in a class action against Concentra Inc., an occupational health provider that provide preemployment screenings for employers.
