State can’t require warning on acrylamide, circuit ruled

Thursday’s 9th U.S. Circuit Court of Appeals ruling upheld an opinion by the Chief U.S. District Judge Kimberly J. Mueller in Sacramento, who enjoined California from enforcing the law as it relates to acrylamide, which shows up naturally in many foods, including coffee.

The 9th U.S. Circuit Court of Appeals ruled that California cannot require Proposition 65 warnings for acrylamide. This is a potentially carcinogenic substance that occurs naturally in small amounts in many foods, including coffee.
