Judge kicks $28M claim, says plaintiff breached contract

“Under no circumstances may the non-breaching party stop performance and continue to take advantage of the contract’s benefits,” Los Angeles County Judge Teresa A. Beaudet’s order stated.

After six years of litigation, a Los Angeles County Superior Court judge dismissed a $28 million breach of contract claim by a vendor for a cosmetology company, finding the plaintiff is the one who violated the agreement.

Defendant Paul Mitchell Advanced Education was granted the motion for summary judgment on March 22.
