Plaintiffs in Zoosk suit seek to remove class representative

According to a motion to dismiss filed by Zoosk on Jan. 28, Collins failed to comply with three court orders compelling her to produce certain discovery items. Collins’ alleged discovery deficiencies included missing interrogatories and a missing attestation of truth in provided discovery.

Dating website Zoosk and the opposing class of plaintiffs presented their respective evidentiary case in the Northern District court for the first time at a sealed hearing on Tuesday in the middle of a contentious discovery battle.

The hearing came in the wake of a failed attempt by the plaintiffs to remove class representative Amber Collins after her alleged discovery violations.
