LinkedIn can’t dismiss ‘generic, conclusory’ data scraping case yet

Throughout the hearing, U.S. District Judge Edward Chen peppered 3Taps’ plaintiff counsel Thomas V. Christopher with questions regarding the lack of facts in his pleading and posing the simple yet puissant question, “Can you even prove this is a business?”

LinkedIn lost its motion Thursday to dismiss a declaratory relief action brought by 3Taps, a data scraping company that was previously embroiled in similar litigation against Craigslist.

U.S. District Judge Edward Chen declined to grant LinkedIn’s motion for an outright dismissal with prejudice despite the court’s acknowledgment that 3Taps’ initial complaint was “generic and conclusory.”
