Tuna price fixing litigation can sue as a class, 9th Circuit rules

U.S. District Court Judge Janis L. Sammartino of the Southern District Court of California was right to analyze conflicting evidence from the parties about how many consumers were harmed by the tuna producers and find the plaintiffs’ expert testimony was enough to show commonality to qualify for class action, a full panel of the court said.

A federal trial judge did not abuse her discretion by certifying three classes of tuna purchasers in a high profile multi-district class action that alleged packaged tuna producers violated antitrust laws when they conspired to fix prices, an en banc panel of the 9th U.S. Circuit Court of Appeals ruled Friday.
