Retired judges can seek discovery in suit against Judicial Council

They are challenging a Judicial Council policy limiting judges to 1,320 days total participation time in the Temporary Assigned Judges Program, which allows retired judges to serve courts with judicial need.

A San Francisco judge has rejected a demurrer against a case brought by seven retired judges.

Superior Court Judge Richard B. Ulmer Jr. ruled on Wednesday the plaintiffs had adequately pleaded their disparate impact age discrimination case and can seek discovery they have long sought.
