Tesla shareholders denied gag on Elon Musk

But U.S. District Judge Edward M. Chen also confirmed what plaintiffs’ attorneys had stated in their brief, that Elon Musk’s two Aug. 7, 2018 tweets concerning taking Tesla private “were in fact false and made with the requisite scienter.”

A San Francisco federal judge has denied a gag order sought by shareholders in a lawsuit against Tesla Inc., concluding the proposed motion was overbroad and unnecessary.
