Foie gras can cross state line despite California law, panel finds

“We hold that the sales ban is neither preempted nor unconstitutional and that the specified transactions are out-of-state sales permitted by California law,” wrote 9th U.S. Circuit Court of Appeals Judge Ryan D. Nelson.

Californians can only buy foie gras if it comes from out of state, a unanimous federal appeals panel ruled Friday, loosening a strict state ban on the delicacy.
