District court should have treated jurist’s ruling as ‘nonbinding’
“Because the magistrate judge lacked the consent of the parties to rule on such matters, he lacked jurisdiction to enter an order denying the application, and the district court should have treated the magistrate judge’s ruling at most as a nonbinding recommendation subject to de novo review,” 9th Circuit Judge Milan D. Smith Jr. wrote.
