Newsom signs law to lift cap on medical malpractice damage awards

Trial lawyer Nicholas C. Rowley said the law opens the door to collaborations between plaintiffs’ attorneys and medical professionals — with another bill likely next year that could help protect doctors’ ability to have tough conversations with patients.

The third rail is no more.

On Monday, Gov. Gavin Newsom signed a bill updating the Medical Injury Compensation Reform Act of 1975. AB 35 will raise the cap on noneconomic medical malpractice damages in a series of steps over a decade. It came together in just a few months, averting a costly and bitter initiative fight.
