Tesla seeks 9th Circuit review of ruling Musk’s tweets were reckless

“Elon Musk is paying them a lot of money so [defense attorneys] had to argue something,” said Adam C. Pritchard, a professor at the University of Michigan Law School.

Attorneys representing Tesla Inc. and its board of directors are seeking interlocutory review by the 9th U.S. Circuit Court of Appeals of a ruling that 2018 statements by CEO Elon Musk were false and reckless.

They are asking U.S. District Judge Edward M. Chen of San Francisco to certify questions to the appellate court before shareholders take their case against the automaker to a trial scheduled for January.
