Avenatti files motion to dismiss 24 of remaining criminal counts
“Proceeding on these counts is violative of the Sixth Amendment and the Speedy Trial Act,” the motion read. “It is Mr. Avenatti’s position that as of the day of this filing, 105 non-excludable days have passed since the indictment was filed.”




Suspended attorney Michael J. Avenatti filed a motion on Friday to dismiss 24 federal criminal counts against him totaling up to about $7 million in fines he did not plead guilty to when he confessed recently to cheating four clients and the IRS. He cited the 6th Amendment and Speedy Trial Act in his motion to dismiss 24 of the remaining 31 charges against him in the Central District of California.
