9th Circuit again says climate lawsuits belong in state court
The ruling is a significant win for state and local governments as this failed motion for reconsideration was the energy companies' final attempt to keep a potential trial out of a state court, which traditionally is less favorable to large corporate defendants.




A 9th Circuit Court of Appeals panel declined on Monday a petition for rehearing en banc of its order from April which ruled that city governments suing energy companies for climate change related damages had to seek relief in state and not federal court.
