Challenge to salary background checks dismissed with leave to amend

“We specifically told applicants, ‘Don’t tell us this information.’ The reason we asked for the W2 was to verify plaintiff’s dates of employment,” said defense counsel Cindy D. Hanson of Troutman Pepper LLP.

Workday and its co-defendant, HireRight, were granted a motion to dismiss Thursday by U.S. District Judge Edward M. Chen against a class action alleging violations of state and federal law related to their use of background checks in hiring decisions.
