Justice Department sides with group homes in Costa Mesa fight

Senior U.S. District Judge James V. Selna of Santa Ana, who has consistently ruled for the city’s attempts to regulate and limit sober living homes.

Two organizations that operate sober living homes in Costa Mesa got assistance from the U.S. Department of Justice during oral arguments Tuesday before a 9th U.S. Circuit Court of Appeals panel against the city's denial of permits for their facilities.

The question is whether Costa Mesa is discriminating against people with disabilities when it restricts permits to individuals with alcohol and illegal drug addictions.
