State Supreme Court takes first PAGA case post-Viking River

Michael Rubin, a partner with Altshuler Berzon LLP who represents plaintiffs in several PAGA cases, said defendants have filed hundreds of motions across the state during the past month to compel arbitration of individual worker claims and dismiss the representative actions on behalf of co-workers.

The state Supreme Court has granted review of a Private Attorneys General Act case that may resolve how California will treat such lawsuits in the wake of a U.S. Supreme Court ruling last month.

The question is how the opinion -- Viking River Cruises v. Moriana, 20-1573 (S. Ct., filed May 10, 2021) -- should be applied in another California case against Uber Technologies Inc.
