PAGA plaintiff asks state high court to quickly reconcile Viking

“​​Until this Court clarifies how state law actually applies to these issues, the lower courts will be required to devote considerable resources to the pending motions, and will inevitably reach conflicting results,” read the application for expedited briefing by Aashish Y. Desai.

The plaintiffs in a Private Attorneys General Act worker classification case asked the California Supreme Court this week to allow expedited briefing because “the lower courts need prompt guidance … as they try to reconcile the outcome in Viking,” referring to a recent U.S. Supreme Court decision that will impact future PAGA claims filed by California workers.
