Qualcomm asks 9th Circuit to block pared down antitrust claim

Several plaintiffs’ firms, including Susman Godfrey LLP and Cotchett, Pitre & McCarthy LLP, filed a slimmed-down complaint after a 9th U.S. Circuit Court of Appeals panel rejected a nationwide lawsuit because common issues of the law did not predominate.

Attorneys for Qualcomm Inc. hope to squelch a smaller version of an antitrust class action against their client.

Robert A. Van Nest, who represents the San Diego company, argued in a Monday evening filing that the claims in a revised complaint “continue to mirror those that the 9th Circuit rejected as a matter of law” in a decision that dismissed a Federal Trade Commission lawsuit.
