Dunn prosecution may hinge on 1990s rule

The bar filed a complaint last month against Dunn, accusing him of misrepresentation and breach of fiduciary duty over his statements to its Board of Trustees concerning the state Supreme Court’s position on legislation and funding for a January 2014 State Bar trip to Mongolia.

A California State Bar rule adopted in the 1990s may be a stumbling block for prosecutors seeking to disbar its former executive director, Joseph L. Dunn.

But a Los Angeles lawyer who represents attorneys in disciplinary proceedings said Wednesday he doubts it will matter -- unless State Bar prosecutors made a pivotal error.
