Municipalities eye local private right of action laws

If many cities and counties were to begin adopt private right of action ordinances, the court system could be affected, not only by challenges to the laws but by citizens filing the actions.

The Los Angeles city attorney is urging an ordinance to allow residents to sue anti-abortion pregnancy centers in the city if they mislead women who come to them seeking abortions. If the council were to adopt the measure it would be the first private right of action enacted by any municipality modeled on one passed by the Texas Legislature that the U.S. Supreme Court allowed to go into effect last year.
