NHL’s $2B COVID insurance claim nears end: ‘Upgrades’ aren’t ‘repairs’

The decision will add to a relatively new area of California case law. Santa Clara County Superior Court Judge Sunil R. Kulkarni’s order builds on a set of opinions issued this year that will serve as controlling precedent for other business owners seeking to recover on similar claims.

A $2 billion lawsuit filed by the National Hockey League and 20 of its teams against their insurance provider to recoup losses related to the 2020 COVID-19 shutdown is on its last legs after a Santa Clara County judge found that COVID-related sanitation remedies throughout the league’s stadiums were “upgrades” and not “repairs.”
