San Francisco appeals ruling that letting noncitizens vote is unconstitutional

San Francisco Superior Court Judge Richard B. Ulmer Jr. had ruled on July 29 that the ordinance was invalid and unenforceable because it is “contrary to the California Constitution and state statutes and thus, cannot stand.”

The City and County of San Francisco filed an appeal to overturn a recent Superior Court decision that rejected as unconstitutional an ordinance allowing non-U.S. citizens to vote in school board elections.

The appeal was filed Tuesday, four days after San Francisco’s attempt to keep the ordinance in place was denied on Aug. 12.
