CARB counsel braces for challenge to ban on sale of gas and diesel powered autos

“I suspect we’ll definitely get state court claims based on some of the comments that were filed, and there might be other cases in the federal courts that involve a lot of those issues that were litigated in the 2005-2008 period,” said the board’s chief counsel, Ellen M. Peter, referring to the board’s greenhouse gas standards proposed in 2004.

The California Air Resources Board voted unanimously Thursday to adopt a rule requiring every vehicle sold in the state to be electric starting in 2035 and the board’s counsel immediately predicted legal challenges.
