Bar opposes new public disciplinary charges in old cases
“The State Bar has argued that the harm to the plaintiff members is fleeting on the purported grounds that these confidential investigations would eventually become public. However, the 2020 State Bar audit shows that only 3.5% of all such investigations become public,” wrote Lenore L. Albert, a sole practitioner in Laguna Beach.
The California State Bar filed a motion in federal court opposing the plaintiff attorneys’ request for a preliminary injunction to stop filing new public disciplinary charges on old matters, partly because of this year’s data breach.
“As explained in the opposition brief filed in court, there is no basis for the plaintiff’s requested injunctive relief,” State Bar General Counsel Ellin Davtyan said in a statement on Monday.
