Salon can sue insurer over COVID closure as an ‘evacuation’
“Plaintiff contends the insurance policy’s civil authority endorsement covered its business losses because the public health orders required evacuation of the business property,” wrote 2nd District Court of Appeal Justice Carl H. Moor.




A 2nd District Court of Appeal panel has found in an unpublished opinion that a Los Angeles nail salon — which sued its insurance company for not paying for its business loss when it was ordered by the state to shut down — can proceed with its case equating the order with an evacuation.
The definition of the word “evacuation” in the policy was contested in the litigation and by the appellate panel.
