Judge removes 3 Mission Viejo City Council members for overstaying terms
“How can a city attorney act adequately and fairly represent the interest of the city while defending council members who are illegally intruding office?” asked the victorious plaintiff’s attorney, Aaron R. Hand of Bunsow De Mory LLP.




The city of Mission Viejo will appeal an Orange County Superior Court judge’s decision to remove the mayor and two councilmen on the basis that they have overstayed their two-year terms and, therefore, “are not lawfully holding their offices.”
Judge Walter P. Schwarm has not finalized his Aug. 31 tentative ruling, allowing the city attorney time to appeal.
