US judge right not to enjoin state law on rifles, panel says

A three-judge panel, which had ruled a San Diego district judge incorrectly decided not to enjoin a state law that barred the sale of semi-automatic center-fire rifles to adults under 21, vacated its May ruling and sent the case back to district court.

The 9th U.S. Circuit Court of Appeals, in what is becoming an ongoing pattern, sent a gun rights case back to district court to apply a June ruling by the U.S. Supreme Court.

A three-judge panel, which had ruled a San Diego district judge incorrectly decided not to enjoin a state law that barred the sale of semi-automatic center-fire rifles to adults under 21, vacated its May ruling and sent the case back to district court.
