Texas law upheld, OKs suits over online changes to comments

“We reject the Platforms’ efforts to reframe their censorship as speech,” 5th U.S. Circuit Court of Appeals Judge Andrew S. Oldham wrote. “It is undisputed that the Platforms want to eliminate speech — not promote or protect it.”

A 5th U.S. Circuit Court of Appeals panel ruled Friday that Texas can start enforcing a law aimed at Silicon Valley social media giants like YouTube, Facebook and Twitter over objections that the decision violates their First Amendment rights.

The divided panel rejected objections by two organizations that represent Alphabet Inc., Meta Platforms Inc., Twitter Inc. and other social media companies that the Texas law is unconstitutional.
