Uber: Under Viking River plaintiff has no PAGA standing

Gibson, Dunn & Crutcher partner Theane Evangelis argued that the plaintiff cannot represent other workers in a PAGA case arguing that Uber misclassified employees as independent contractors because his own lawsuit was referred to arbitration.

Attorneys for Uber Technologies Inc. told the state Supreme Court that a plaintiff who filed a Private Attorneys General Act claim on behalf of his co-workers does not have standing to do so in light of a June U.S. high court decision.
