‘Top Gun: Maverick’ facts not copyrightable, studio counters

The plots and sequence of the two works — one being the 1986 investigative report by the late Ehud Yonay and the other the Tom Cruise-starring blockbuster sequel — are “fundamentally dissimilar,” wrote Molly M. Lens and Daniel M. Petrocelli of O’Melveny & Myers LLP in a motion to dismiss filed Wednesday in Los Angeles.

The lack of substantial similarity between the “Top Gun” sequel released this summer and a 1983 magazine article that inspired the original movie is “fatal” to the author’s widow and son’s copyright claims and should be dismissed, attorneys for Paramount Pictures wrote in a motion to dismiss.
