Supreme Court turns down chance to address cy pres

“I couldn’t say whether idiosyncratic issues with this case caused the court to believe it was not a good vehicle or whether the court has lost interest,” Theodore H. Frank said.

For nearly a decade, federal judges have expressed misgivings about cy pres settlements in the wake of the 2013 opinion by Chief Justice John G. Roberts Jr. expressing doubts about them and an interest in imposing limits.
