Gopuff grocery app sued for failure to disclose auto-renewal
“By signing up for Fam and providing us with your payment account information, you expressly acknowledge and agree that you are signing up to an auto-renewing subscription requiring recurring payments and agree to pay the then-current applicable fee associated with the Fam subscription,” states the terms and conditions page in bold text on Gopuff’s site. The lawsuit says customers must scroll down on a phone app to see the notice, after they have already pressed a button to start a free trial.




A putative class action against grocery shopping and food delivery company Gopuff is the latest in a series of lawsuits accusing corporations of skirting California’s automatic subscription renewal laws and violating the state’s advertising guidelines.
