Validity of thousands of removal orders threatened, 9th Circuit dissenters say

“The panel’s erroneous decision casts doubt on the validity of potentially tens of thousands of in absentia removal orders that have been issued in this circuit over the last two decades,” 9th Circuit Judge Daniel P. Collins wrote for the dissenters.

In a decision that drew sharp dissents from conservative judges, the 9th U.S. Circuit Court of Appeals has ruled that the government, when issuing removal orders, must include the date and time of upcoming hearings in a single document.

Twelve judges appointed by Republican presidents dissented from the circuit’s Wednesday decisions not to reconsider en banc two cases involving immigrants who entered the country without legal permission.
