New US ghost gun rules violate Administrative Procedure Act, complaint says

Scott A. Edelman of Gibson Dunn & Crutcher LLP said, “Two years ago, we filed our lawsuit demanding that ATF take action on the ghost gun epidemic plaguing communities around the country. Unfortunately, the action they took didn’t go far enough and allows ghost gun sellers and manufacturers to skirt the common sense gun safety regulations set forth in the Gun Control Act, like requiring guns to be serialized and gun purchasers to undergo background checks.”

California and the Giffords Law Center to Prevent Gun Violence filed an amended complaint against the Bureau of Alcohol, Tobacco, Firearms and Explosives alleging the agency’s new August regulation to hamper the spread of ghost guns violated the Administrative Procedure Act.

Supervising Deputy Attorney General R. Matthew Wise and Deputy Attorney General Sean Clinton Woods represent the state. They did not respond to requests for comment.<...
