Last-minute attorney dispute before testimony in NCAA trial
Despite taking extra days to hammer out which evidence would be admissible, Orrick Herrington & Sutcliffe LLP partner David P. Fuad, who represents the NCAA, told Superior Court Judge Terry A. Green as the jurors were about to be let in that the plaintiff’s attorneys were not honoring a previous agreement about the deposition testimony of NCAA Chief Medical Officer Dr. Brian Hainline.




A Superior Court jury saw extensive video testimony Monday in a wrongful death trial against the NCAA, which is accused by the widow of a former USC linebacker of keeping athletes in the dark about the dangers of head injuries from playing football.
Only the second concussion lawsuit against the NCAA to go to trial, the verdict will be an important barometer for hundreds of similar lawsuits against the college athletic organization.
