No en banc review of acrylamide injunction denial, split court decides

The injunction will stand — a victory for the California Chamber of Commerce. The legal battle between the chamber, the state, and the Council for Education and Research on Toxics will continue in district court.

Over the objections of five liberal dissenters, the 9th U.S. Circuit Court of Appeals on Wednesday decided against reconsidering en banc a judge’s denial of a preliminary injunction blocking new lawsuits to enforce a warning requirement for acrylamide.
