Plaintiff rejects San Francisco claim that police didn’t know of DNA crime lab

This argument, housed in a new brief filed Friday, challenges the motion to dismiss which claims that the San Francisco Police Department was unaware of the database. The case stems from the arrest of the plaintiff for suspected burglary in December 2021, based on matching her DNA from a rape kit.

An anonymous plaintiff who is suing the City and County of San Francisco for maintaining victims’ DNA in a criminal database claims the city knew of the database’s existence.
