A 9th U.S. Circuit Court of Appeals panel peppered a lawyer for Apple Inc. with questions during oral arguments Monday over whether the company should be considered a monopolist in its dealings with game developer Epic Games Inc.

But 9th Circuit Judge Milan D. Smith Jr., an appointee of President George W. Bush, also had tough questions for Thomas C. Goldstein, a partner with Goldstein & Russell P.C. who represents Epic Games.
