No high court review of Starkist class certification

The ruling rejected Latham & Watkins partner Gregory G. Garre’s argument that 28% of the class members were not injured.

The U.S. Supreme Court denied review of the 9th U.S. Circuit Court of Appeal’s rejection of a StarKist Co. appeal that said the court wrongly certified classes of tuna buyers.

The ruling, announced Monday, rejected Latham & Watkins LLP partner Gregory G. Garre’s argument that 28% of the class members were not injured. StarKist Co. et al. v. Olean Wholesale Grocery Cooperative Inc., 22-131 (S. Ct., filed Aug. 10, 2022).
