DAs to appeal dismissal of Potter Handy case

The prosecutors say a judge erred in finding the law firm’s filing of Americans with Disabilities Act lawsuits against small businesses was shielded from prosecution under litigation privilege.

San Francisco and Los Angeles County district attorneys will appeal a judge’s ruling that the litigation privilege protects Potter Handy LLP from the prosecutors’ claims that the firm committed fraud by preparing and filing lawsuits under the Americans with Disabilities Act.
