Suit over children under ‘Remain in Mexico’ policy heads to bench trial

Immigrant Defenders Law Firm, a nonprofit legal defense organization in Los Angeles, alleged in its complaint filed in 2021 that the Department of Homeland Security violated the due process rights and congressional protections of unaccompanied migrant children in connection with the Migrant Protection Protocols, or “Remain in Mexico” program implemented in 2019 under President Donald Trump.

A lawsuit against the U.S. Department of Homeland Security brought by an immigration advocacy group asking the government to stop sending children back to Mexico to await asylum hearing dates will likely go to a bench trial in the coming months, a federal judge told attorneys on Tuesday.
