High court to weigh how far attorney-client privilege extends
Petitioners in the case, as well as an amicus curiae brief filed by the California Lawyers Association, argue that the 9th Circuit ruling should be reversed because it narrows attorney-client privilege in a way that conflicts with opinions from other circuits.
The U.S. Supreme Court is considering how far attorney-client privilege extends in situations in which clients seek advice that is not exclusively legal but relates to business, taxes and other issues.
The justices are scheduled to hear arguments in January in a case reviewing a 9th U.S. Circuit Court of Appeals panel affirmance of a lower court decision that held an unidentified company and law firm in contempt in a tax case.
