A recent 9th U.S. Circuit Court of Appeals ruling protecting insurers from liability for COVID-19 business losses is rippling out into other cases.
In a motion to reconsider filed just before the Thanksgiving holiday, attorneys for Factory Mutual Insurance Co. (FM) cited the appellate court’s finding that “the contamination exclusion must refer only to ‘viruses that are not communicable diseases.’”
