Yelp says one-way recording class action is a first

Yelp said this case was a first of its kind, where plaintiffs are asserting claims based on one-sided recordings. The company argued class certification faces insurmountable barriers putative class members would not be able to identify themselves, plaintiffs failed to show that common issues would predominate and it only engaged in one-sided recordings, where only what their sales representatives said were recorded.

Plaintiffs who were called by Yelp Inc. sales representatives promoting advertising space asked a judge Friday to certify a class, alleging Yelp recorded millions of their telephone communications without their knowledge or consent.
