Does ‘leniency’ inspire companies to report wrongdoing?
The Department of Justice now has increased its incentives for companies to hold themselves accountable by promptly disclosing all nonprivileged information about individuals committing misconduct; the agency will not seek guilty pleas from companies that voluntarily disclose, fully cooperate with an investigation and fully remediate the root cause of the wrongdoing.
