US justices ask Biden administration to weigh in on CalTech patent dispute

The case concerns data transmission patents used in Wi-Fi chips. But as important as the case is to the university and technology companies, the Supreme Court — if it grants review — may resolve whether and how defendants can challenge a patent’s invalidity.

The U.S. Supreme Court asked the Biden administration Tuesday to express its views over whether Apple Inc. and Broadcom Inc. can revive their invalidity challenges to two California Institute of Technology patents.

U.S. District Judge George H. Wu in Los Angeles barred the technology companies’ attempts to introduce arguments that the patents were invalid because they could have raised them in inter partes review proceedings before the U.S....
