US agencies appeal judgment over wildlife in ship lanes

“The lower court correctly held that the Endangered Species Act requires the Coast Guard and NOAA to conduct an honest assessment of the impact Coast Guard shipping lane designations have on ship strikes of endangered whales in the approaches to California’s ports,” Brian P. Segee of the Center for Biological Diversity said.

The National Marine Fisheries Service and the U.S. Coast Guard on Monday appealed a federal judge’s order granting summary judgment in favor of the Center for Biological Diversity, which accused the agencies of failing to make an adequate effort to protect endangered marine life from being struck by ships.
