Business groups, politicians challenge contribution limits

They argued that SB 1439 inappropriately amended the Political Reform Act of 1974 because the initiative measure specifically excluded campaign contributions from the definitions of “gift” and “income” and restricts local, but not state, officials.

Eight business groups and two politicians challenged California’s new limits on campaign contributions as an unconstitutional restriction on speech.

Senate Bill 1439, which went into effect Jan. 1, is “overbroad and not closely drawn to the only legitimate government interest appropriate in limiting campaign contributions,” the groups wrote in the lawsuit filed Wednesday against the Fair Political Practices Commission.
